This page and its sub-pages tell you everything you need to know about how Nuvem Group, LLC and/or its affiliates and newly acquired companies (“Nuvem Group”; “Nuvem”; “we”; “us”; “our”) protect the personal data we process and control relating to you (“your personal data”; “your data”) and which rights you have in relation to the processing of your personal data.

This Privacy Policy explains how we protect your information gathered via (1) the Web pages of the Nuvemgroup.com website that are designated as United States in the upper right hand corner or Web pages of any other website with respect to which this Privacy Statement is posted or linked (such Web pages are collectively referred to as the “Website”), (2) downloadable applications accessed from mobile devices with respect to which this Privacy Statement is posted or linked (“Mobile Apps”) or (3) any other mode of interacting with you relating to Nuvem Group communications, such as online or offline newsletters and magazines, that reference this Privacy Statement (“Communication”).

By using the Website or Mobile Apps, or continuing to receive Communications, you agree to the use of such information in accordance with this Privacy Policy.

The Nuvemgroup.com website also includes Web pages provided by Nuvem Group, LLC (“Nuvem”), which are designated as “Global,” and Web pages provided by other Nuvem member firms or their related entities, which are designated according to the location identified in the upper right-hand corner next to “Location.” These Web pages are provided by the designated entities and are not the responsibility of Nuvem Group. Such Web pages, as well as other websites that may be linked to the Website, are not governed by this Privacy Policy. As used in this Privacy Policy, “Nuvem Network” means Nuvem and its member firms and their affiliates and related entities.

Information Collection

Nuvem Group, and its subsidiaries and affiliates, is a privacy conscious organization. Your privacy is very important to us and protecting your personal data is a top priority. We want you to feel secure that when you deal with Nuvem Group, your personal data are in good hands.

In accordance with applicable laws and our data privacy policies, Nuvem Group is committed to respecting your privacy and protecting your personal data, which is any information that is capable of identifying you as an individual person, collected via all websites or apps that post a link to this Privacy Policy (collectively, “the Sites”). In addition, we maintain the appropriate technical measures and organizational processes to protect your personal data against unauthorized or unlawful processing and/or against accidental loss, alteration, disclosure or access, or accidental or unlawful destruction of or damage thereto.

We may collect personal information when you interact with the Website or Mobile Apps, such as if you choose to register or create a user profile on the Website or a Mobile App (e.g., to gain access to specific content, register for or apply for jobs through the Nuvem Group Recruitment Portal, register for newsletters and alerts, attend a hosted event, respond to a survey or request communications about specific areas of interest), or otherwise provide it to us. Depending on the specific Communication you are receiving, or the Web page of the Website or Mobile App you are using, the personal data collected may include information that you provide, such as your name, current job title, company address, email address, telephone and fax numbers, correspondence with you, which newsletters you subscribe to, background information required to apply for a job, and other information you provide to us.

When using a Mobile App or interacting with any of our Sites, in addition to contact information, we may also collect information relating to your device, including your device model, operating system, browser type, unique device identifier, IP address, mobile phone number, mobile network carrier, location, and the way you are using the Mobile App. The information collected will depend on the functionality of the specific Mobile App you are using. If any other information is collected relating to your use of a Mobile App, such information will be specified in the Mobile App.

We may also automatically collect browsing information collected through cookies, web beacons, pixels, clear gifs, and other similar technologies (collectively “Cookies and Other Tracking Technologies”) on our Sites. We may also automatically collect information about how you use the Sites, such as what you have searched for and viewed on the Sites. The information automatically collected will be associated with any personal data you have provided.

We may also collect personal information if you register for the Website using a third party social network account (e.g., LinkedIn, Facebook, and Twitter). For example, the Website or a Mobile App may allow you to login using your social network account credentials. We may collect the user name associated with that social media account and any information or content you have permitted the social media network to share with us, such as your profile picture, email address, and birthday. The information we collect may depend on the privacy settings you have with the social network site, so please review the privacy statement or policy of the applicable social network site. When you access the Website through your social network account, you are authorizing us to collect and use your information in accordance with this Privacy Statement.

The Website may also collect content that you provide, including postings on blogs, forums, wikis and other social media applications and services that we may provide.

We do not usually seek to collect sensitive personal information (i.e., data relating to race or ethnic origin, religious or philosophical beliefs, trade union membership, political opinions, medical or health conditions, or information specifying the sex life or sexual orientation of an individual) from users. We will, where necessary, obtain your explicit consent to collect and use such information.

When using a Mobile App or interacting with any of our Sites, in addition to contact information, we may also collect information relating to your device, including your device model, operating system, browser type, unique device identifier, IP address, mobile phone number, mobile network carrier, location, and the way you are using the Mobile App. The information collected will depend on the functionality of the specific Mobile App you are using. If any other information is collected relating to your use of a Mobile App, such information will be specified in the Mobile App.

Log information, cookies and Web beacons

The Website and Mobile Apps collect standard Internet log information including your IP address, browser type and language, access times and referring website addresses. To ensure that the Website, Mobile Apps and Communications are well managed and to facilitate improved navigation, we or our service provider(s) may also use cookies (small text files stored in a user’s browser) or Web beacons (electronic images that allow us to count users who have accessed particular content and to access certain cookies) to collect aggregate data. Information transfers; Privacy Shield Notice

Nuvem Group adheres to the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce with respect to personal information that is transferred from the European Economic Area, the United Kingdom and Switzerland to the United States within the scope of Nuvem Group’s Privacy Shield certifications. Unless indicated otherwise with respect to a particular transfer, Nuvem Group relies on Privacy Shield for such transfer. To learn more, see our Privacy Shield Notice.

Use of information

The personal data we collect may be used where we have your specific consent to provide you with access to the Website, Mobile Apps and Communications, or where we have a legitimate business interest in or other legal basis for collecting, processing, and using such information. The personal information you submit to us may be used to manage our relationship with you, including any of your requests, or to customize or improve the Website or a Mobile App and related services offered to you.
Nuvem Group uses your personal data to fulfill your requests for information, process your requests to participate in conferences and events, personalize content that you view or receive on the Sites, evaluate and improve our services, distribute newsletters and alerts to you, recruit and evaluate job applicants, analyze the Sites’ performance and functioning, publish your letters to the editor or comments, prevent fraud, enforce our terms of use, comply with all applicable laws and corporate reporting obligations, enforce Nuvem Group’s agreements, and accomplish other purposes you may initiate or request. We may keep any of your personal data on file and use it to contact you.

We may also use your personal information for marketing purposes, or to send you promotional materials or communications regarding services provided by us or other members of the Nuvem Network that we feel may be of interest to you. We may also contact you to seek feedback on services provided by members of the Nuvem Network or for market or other research purposes. Your personal information may also be used to protect our rights or property and that of our users.
You may at any time request that we discontinue sending you Communications, emails or other correspondence.

Nuvem Group may use first and third party Cookies and Other Tracking Technologies to manage our Sites and our services and collect analytics about how you use them. The information provided throughout this Privacy Policy about cookies also applies to these other tracking technologies. Please refer to our Cookie Policy for more details regarding our use of cookies.

We generally do not require collected information to obtain access to any area of the Site. However, if you decide to provide personal information to the Company, in no case will the Company sell, license or transmit that information to third parties, except as required or permitted by law. Any information that you voluntarily share with the Company in a form is kept strictly confidential and fully secure.

Disclosure of information to third parties

We may provide your personal information to other members of the Nuvem Network in order to provide you with information that could be of interest to you and conduct market or other research. Your personal information may also be disclosed to members of the Nuvem Network and other third parties in order to respond to your requests or inquiries; as part of a corporate transaction (such as a sale, divestiture, reorganization, merger or acquisition); or where those parties handle information on our behalf.

Personal information may also be disclosed to law enforcement, regulatory or other government agencies, or to other third parties, in each case to comply with legal, regulatory, or national security obligations or requests.
In relation to Mobile Apps, we may share your usage and personal information with mobile carriers and platform providers, as well as any other entities described in any particular Mobile App in connection with the operation of the Mobile App. We may also use third party service providers to analyze non-personally identifiable user activity to fix errors, monitor usage, and improve the performance of the mobile applications. For example, Nuvem Group receives reports on some of our mobile applications’ aggregate usage and browsing patterns, including information about the type of device used, articles accessed, and other events occurring within our apps. Nuvem Group also receives reports on certain errors occurring within mobile applications. None of these third party service providers gathers information in a manner intended to identify any particular user personally.
In relation to Communications, we may share your personal information with service providers in connection with the delivery of such Communications.
All of these disclosures may involve the transfer of personal information to countries or regions without data protection rules similar to those in effect in your area of residence.
By providing information with respect to a Communication or through the Website or a Mobile App, you are consenting to the disclosures described above.

Data recipients and international data transfers

Personal data collected on the Sites may be transferred from time to time to Nuvem Group subsidiaries and affiliates and their personnel across our global organization, as well as to our third party service providers located throughout the world, including in countries where the local law may grant you fewer rights than you have in your own country. Additionally, the Sites may be viewed and hosted by Nuvem Group and our third party service providers anywhere in the world. Where required by law, we have put in place legal mechanisms designed to ensure adequate data protection of your personal data that is processed by Nuvem Group subsidiaries, affiliates and third- party service providers, including the transfer of your personal data to countries other than the one in which you reside. By using any of the Sites and providing information on any of them, you voluntarily consent to such trans-border transfer and hosting of such information.
Nuvem Group will not intentionally disclose or transfer (and will take reasonable steps to prevent the unauthorized or accidental disclosure of) your personal data to third parties without your consent, whether for such third parties’ own marketing purposes or otherwise, except as follows. Nuvem Group may provide access to your personal data to third party service providers engaged by Nuvme Group to provide services related to the Sites, provided that such third- party service providers will first agree to maintain the strict confidentiality of such information and provide the same level of data security as provided by Nuvem Group.
We also may share your personal data with third party service providers who perform services and functions on our behalf to support our interactions with you, including, for example, processing recruitment materials, administering surveys or contests, or communicating with you. These third party service providers are not permitted to use or disclose your personal data except as necessary to perform services on our behalf or to comply with legal requirements.
In addition, we may disclose information about you:
If we are required to do so by law or legal process;
To law enforcement authorities or other government officials;
When we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity;
If disclosure is necessary to protect the vital interests of a person;
To enforce our Terms of use;
To protect our property, services and legal rights;
To prevent fraud against Nuvem Group, our subsidiaries, affiliates and/or business partners;
To support auditing, compliance, and corporate governance functions; or
To comply with any and all applicable laws.
We maintain processes designed to ensure that any processing of personal data by third party service providers is consistent with this Privacy Policy and protects the confidentiality, availability, and integrity of your personal data.
In addition, we may disclose or transfer your personal data in the event of a re-organization, merger, sale, joint venture, assignment, or other transfer or disposition of all or any portion of our business.

Blogs, forums, wikis and other social media

The Website may host various blogs, forums, wikis and other social media applications or services that allow you to share content with other users (collectively Social Media Applications). Any personal information or other information that you contribute to any Social Media Application can be read, collected and used by other users of that Social Media Application over whom we have little or no control. Therefore, we are not responsible for any other user’s use, misuse or misappropriation of any personal information or other information that you contribute to any Social Media Application.

The Sites may allow you to sign into and associate your social network accounts including, but not limited to, Twitter, LinkedIn, Facebook, and YouTube, with Nuvem Group. The Sites also may allow you to log in to a Nuvem Group account using certain social network account credentials.
By associating your social network account with Nuvem Group or logging in to a Nuvem Group account using your social network account credentials, you give us permission to access information that you have made available in your public profile for that social network account. The information available in your public profile varies based on the social network and your settings, but may include your email address, real name, profile picture, gender, and location. We use the information we receive from your social network account in accordance with the social network’s terms of use and this Privacy Policy. Please refer to the privacy settings in your social network account for information about what data is shared with Nuvem Group and other connected applications and to manage the data that is shared through your account, including information about your activities using our Sites.
If you would like to disconnect a social media account from us, refer to the settings of that social network account and its provider.

Privacy practices of third parties

This Privacy Policy only addresses the use and disclosure of information collected by Nuvem Group through your interaction with the Website and the Mobile Apps and through other interactions with Nuvem Group relating to a Communication. Other websites or mobile apps that may be accessible through links from the Communication, Website, or Mobile Apps have their own privacy statements and personal information collection, use and disclosure practices. You should be aware that whenever you publicly disclose information online, that information could be collected and used by others. Nuvem Group is not responsible for any action or policies of any third parties who collect information that users publicly disclose in any such forums on the Sites. We encourage you to familiarize yourself with the privacy statements provided by these other parties prior to providing them with information.

Data retention

We retain personal information, as necessary, for the duration of the relevant business relationship and purpose outlined in this Privacy Policy. Notwithstanding the duration of the purpose, we may retain your information if necessary to comply with our legal or professional obligations, enforce our agreements, resolve disputes, use it for analysis or historical record-keeping, or comply with our information management policies and schedules. If you request that we delete your personal data, Nuvem Group will make reasonable attempts to delete all instances of the information in their entirety. For requests for access, corrections, or deletion, please refer to the “Your Rights” section of this Privacy Policy.

Rights to access and control your personal information

You have choices about how your personal information is collected, used and shared.
If you choose to register for a Communication or with the Website or a Mobile App, you may access your user profile, correct and update your details, or unsubscribe at any time. If you decide that you no longer wish to have your third party social network site account (e.g., LinkedIn, Facebook, or Twitter) linked to your profile on the Website or a Mobile App, you may change your account settings at any time. If you have any problem accessing your profile, or would like to request a copy of your profile, please contact us.
Under applicable law, you may have the right to access or obtain a copy of the personal information that we have collected about you, or to review, modify, delete, or to request that we stop processing such personal information. If you have any questions, please contact us.

Applicable laws may give you the right to lodge a complaint with a local supervisory authority related to this Privacy Statement.

Special notices to California residents

In response to California law, if you are a California resident, you are entitled to request information concerning whether your personal information has been disclosed to nonaffiliated third parties for their direct marketing purposes. We do not share your personal information with nonaffiliated third parties for such purposes.

Do Not Track

We do not engage in the collection of personal information about your online activities over time and across third-party websites or online services to provide targeted advertising and we do not allow third parties to collect such personal information when you use the Website.

Protection of Personal Data at Nuvem Group

At Nuvem Group, we believe that great privacy rests on great security. We use administrative, technical, and physical safeguards to protect your personal data, taking into account the nature of the personal data and the processing, and the threats posed. We have in place generally accepted and reasonable commercial standards of technology and operational security to protect all personal information provided by users, and we are constantly working to improve on these safeguards to help keep your personal data secure from any loss, misuse, alteration, or destruction.

Children’s Privacy Protection

We understand the importance of protecting children’s online privacy. Communications, the Website and Mobile Apps are not designed for or intentionally targeted at children under the age of 13. It is not our policy to intentionally collect or maintain information about anyone under the age of 13. If we obtain actual knowledge that we have received such information, we will take steps to delete it.

Changes to our Privacy Policy

By using the Sites, you consent to the collection, use, and storage of your personal data by us in the manner described in this Privacy Policy and elsewhere on the Sites. We reserve the right to make changes to this Privacy Policy from time to time at our discretion. When we make changes to this Privacy Statement, we will amend the revision date at the top of this page and such modified or amended Privacy Statement shall be effective as to you and your information as of that revision date. Privacy Questions

You can also ask us questions about how to submit a privacy complaint and we will endeavor to help.

Nuvem Group takes your privacy questions seriously. A dedicated team reviews your inquiry to determine how best to respond to your question or concern, including those inquiries received in response to an access or download request. In most cases, all substantive contacts receive a response within seven days. In other cases, we may require additional information or let you know that we need more time to respond.

Where your complaint indicates an improvement could be made in our handling of privacy issues, we will take steps to make such an update at the next reasonable opportunity. In the event that a privacy issue has resulted in a negative impact on you or another person, we will take steps to address that with you or that other person.

If you are not satisfied with Nuvem Group’s response, you may refer your complaint to the applicable regulator. If you ask us, we will endeavor to provide you with information about relevant complaint avenues which may be applicable to your circumstances.

When there is a material change to this Privacy Policy, we’ll post a notice on this website at least a week in advance of doing so and contact you directly about the change if we have your data on file.
